The Saint Sylvester Political Agreement, signed in 2016, marked a significant turning point in the political landscape of the Democratic Republic of Congo. This agreement aimed to manage the political transition and ensure peaceful elections, but it conflicts with the Constitution of February 18, 2006, which establishes fundamental principles for the organization of institutions and the conduct of public affairs. In this article, we will explore the legal tensions and challenges this agreement raises with respect to constitutional provisions, while examining the prospects for the evolution of the Congolese political situation. We will highlight the implications of these interactions for democracy and the rule of law in the country.
