The Tribunal de Paix of Tshilenge, a local court in the Democratic Republic of Congo, faces significant dysfunctions that impede access to justice. This study investigates the structural factors behind these dysfunctions, focusing on understaffing, inadequate infrastructure, and poor administrative management. A qualitative approach, combining semi-structured interviews, field observations, and documentary analysis, was used. Results indicate that shortages of judges and clerks, dilapidated buildings, and lack of support mechanisms for litigants create a vicious cycle of inefficiency and distrust. Recommendations include strengthening personnel, rehabilitating infrastructure, improving internal governance, and implementing user guidance and information systems. This study contributes to understanding the challenges of rural justice and proposes practical solutions tailored to the Congolese context.
