The activity of interest representation carried out on behalf of third countries before the European Union raises as many difficulties for the European Union legislator as for the national one. While the European Parliament, through its special working Committees on Foreign Interference in all Democratic Processes in the European Union, including Disinformation, has identified the main legal notions and adapted guidelines, the publication of the proposal for a directive COM(2023) 637 final by the European Commission, which aims to assimilate this activity to a simple service within the meaning of Article 57 of the T.F.E.U., governed by the principles of the internal market, marked a step backwards in the regulation of this special activity, for the Member States and the European Union institutions, whose room for maneuver is thus strongly restricted.
